1. Data controller

The controller of personal data processed in connection with the use of btgrow.eu is BTGROW Sp. z o.o., with its registered office at ul. Cieszyńska 13, 30-015 Kraków, Poland, entered in the National Court Register (KRS) under number 0001099735, tax ID (NIP) 6772509066, REGON 528361433 (the “Controller”).

The Controller has not appointed a Data Protection Officer, as it is not required to do so under Art. 37 GDPR.

2. What data we process and why

a) Contact form and e-mail correspondence

Scope: name, e-mail address and message (required), company name (optional), selected subject, and any data you choose to include in your message or further correspondence.

Purposes and legal bases:

• responding to your enquiry and handling related correspondence: Art. 6(1)(f) GDPR; our legitimate interest is communicating with current and prospective business partners, distributors and brands,
• taking steps at your request prior to entering into a contract, where the enquiry concerns cooperation: Art. 6(1)(b) GDPR,
• establishing, exercising or defending legal claims: Art. 6(1)(f) GDPR.

Contact form data is not used for marketing or transferred to sales systems. We do not send newsletters, and submitting the form does not constitute consent to marketing communications.

Providing data is voluntary, but we cannot accept an enquiry without your name, e-mail address and message.

b) Technical connection data

Whenever you visit the site or submit the form, our infrastructure provider (Cloudflare) processes technical data: IP address, requested URL, date and time, and browser and connection data. Purpose: delivering the site, ensuring security and diagnosing errors, Art. 6(1)(f) GDPR. The content of the form is not intentionally stored in logs.

The site does not use analytics tools, advertising pixels or profiling.

3. Recipients

Your data is processed on our behalf under data processing agreements (Art. 28 GDPR) by:

• Cloudflare, Inc.: website hosting, CDN, form handling and delivery of form messages,
• Google (Google Workspace): the bok@btgrow.eu mailbox where we receive and handle enquiries,
• providers of accounting and legal services to us, to the extent necessary.

Only authorised BTGROW personnel have access to enquiries.

Data may be disclosed to public authorities where required by law.

4. Transfers outside the EEA

Cloudflare, Inc. and Google LLC are based in the USA. Transfers to the USA may take place on the basis of the European Commission's implementing decision of 10 July 2023 on the EU-US Data Privacy Framework (Art. 45 GDPR) and, otherwise, on the basis of Standard Contractual Clauses adopted by the European Commission (Art. 46(2)(c) GDPR). 5. Retention

• Enquiries not followed by cooperation: up to 12 months after the last contact.
• Correspondence relating to established cooperation: for the duration of the cooperation and then until the limitation period for claims expires, generally 3 years (Art. 118 of the Polish Civil Code).
• Technical data in infrastructure logs: for as long as necessary for security and diagnostics, no longer than 30 days.

After these periods, data is deleted, including from the mailbox archive. If you object, we will stop processing your data unless we demonstrate compelling legitimate grounds or the need to defend legal claims.

6. Your rights

You have the right to:

• access your data and obtain a copy (Art. 15 GDPR),
• rectification (Art. 16 GDPR),
• erasure (Art. 17 GDPR),
• restriction of processing (Art. 18 GDPR),
• portability of data processed on the basis of a contract (Art. 20 GDPR),
• object to processing based on legitimate interest (Art. 21 GDPR),
• lodge a complaint with the Polish supervisory authority, Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa, Poland (Art. 77 GDPR), or with the supervisory authority in your country of residence or work.

Send requests to bok@btgrow.eu. We will respond within one month. For complex requests this may be extended by a further two months, in which case we will inform you before the first month ends (Art. 12(3) GDPR).

We do not carry out automated decision-making, including profiling (Art. 22 GDPR).

7. Cookies and browser storage

The site does not set cookies. We store only your selected language version (pl/en) in your browser's local storage (localStorage). This is strictly necessary for the function you request and is not used to identify you, so no consent is required. You can delete it at any time in your browser settings.

8. Fonts

The site uses Google Fonts. When the page loads, your browser connects to Google servers, which receive your IP address and browser data. Legal basis: Art. 6(1)(f) GDPR (correct display of the site). Details: https://policies.google.com/privacy

9. Changes

We may update this policy, in particular following changes in law or in the site's functionality. The current version is always available at btgrow.eu/privacy-policy.
